1. State of Karnataka, Represented by its Secretary, Urban Development Authority, M.S. Building, Bangalore – 560 001.
2. City Municipal Council, Channapatna, Ramanagara District – 562 160.
Represented by its Commissioner. …Respondents (By Sri.M.A.Subramani, HCGP for R1; Sri.A.V.Gangadharappa, Advocate for R2) These Writ Petitions are filed under Articles 226 and 227 of the Constitution of India praying to direct the respondent particularly R-2 to enter the names of the petitioners in E-Katha in respect of properties mentioned in the schedule.
These Writ Petitions coming on for Orders this day, the Court made the following:
O R D E R Sri.A.V.Gangadharappa, learned counsel, is permitted to file his vakalath on behalf of respondent No.2.
2. The petitioners are said to be the owners of the sites purchased through sale deeds executed on 30.3.1993.
3. The petitioners submit that their names have been entered in the assessment list of the City Municipal Council and they have been paying taxes. The petitioners further submit that khata has been entered into the names of the petitioners as per Annexures ‘K’ and ‘N’ and taxes are being paid to the authority.
4. The petitioners state that they had sought for issuance of ‘E’ khata with respect to the schedule property and had been making representations to the authority including the representations dated 19.7.2018 and 3.7.2018, which are produced at Annexures ‘R’ and ‘S’ respectively.
5. Sri.A.V.Gangadharappa, learned counsel appearing on behalf of the respondent No.2 states that they would consider the application at Annexures ‘R’ and ‘S’, within a period of four months from the receipt of a copy of the order passed herein.
6. Noting the same, Writ Petitions are disposed of, directing the respondent No.2 to dispose of the representations at Annexure ‘R’ and ‘S’, within a period of four months, in accordance with law and procedure prevailing.
Accordingly, I.A.No.1/2019 is also disposed of.
