The Special Land Acquisition Officer, H.R.P.-2, Hassan – 573 201. … Respondents This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to direct R-3 to pay the enhanced compensation on the light of the judgment pronounced by this Hon’ble Court in M.F.A. No.5160/2007 vide Annexure – C and etc., This Writ Petition coming on for Orders, this day, the Court made the following:-
ORDER None for the petitioner.
Taking into account the order which this Court proposes to pass, it is not necessary to issue notice to the respondent.
2. In this petition, the petitioner inter alia has prayed for the following relief:
“a) Issue a writ of mandamus directing the 3rd respondent to pay the enhanced compensation on the light of the judgment pronounced by this Hon’ble Court in M.F.A.No.5160/2007 as per Annexure-C.”
3. On perusal of the averments made in the writ petition, I deem it appropriate to dispose of the writ petition with a direction that in case petitioner submits the representation with regard to his grievance before respondent No.3 for enhanced compensation, the same shall be dealt with in accordance with law by a speaking order in light of the judgment in MFA No.5160/2007 within a period of two months from the date of receipt of certified copy of the order passed today.
4. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petition is disposed.
