Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
The only grievance of the petitioner is that his appeal No.109 of 2019 is pending before the second respondent but the same has not been decided so far.
Learned Standing Counsel fairly states that in case the appeal is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the respondent no.2 to consider and decide petitioner's aforesaid appeal by a speaking order within a period of six weeks from the date of production of a certified copy of this order before him.
As an interim measure, it is provided that meanwhile, if any allotment/settlement of the fair price shop in question is made, the same would be subject to the final decision of the Appellate Authority.
