The sole relief claimed in the instant petition is for a direction to the Prescribed Authority, before whom P.A. Case No. 39 /2013 under Section 21(1)(a) of U.P. Act No. 13 of 1972, is pending, to decide the same, within a specified time.
A perusal of the order sheet reveals that the opposite party is already contesting the proceedings and has also led evidence in support of his case. However, the matter is hanging since the year 2013, although Rule 15(3) of the Rules framed under the Act requires disposal of the application, as far as possible, within a period of two months.
Having regard to the facts of the case, the instant petition is disposed of by directing the Prescribed Authority to make all endeavour to decide the proceedings expeditiously, preferably within a period of six months from the date of production of a certified copy of this order.
