Heard the learned counsel for the petitioners and learned Government Pleader for Revenue appearing for respondents 1 and 2.
The petitioners along with others were given notice, dated 17.08.2013, by the Revenue Divisional Officer, Mantheni, the 2nd respondent, to produce the documents relating to the subject land, which were found to be in different extents in Survey Nos.42 and 43. The petitioners state that they have given reply along with the documents. Later, the petitioners were advised and they have filed applications for grant of Occupancy Rights Certificate (ORC), dated 16.04.2014, which were acknowledged by the office of the Revenue Divisional Officer on 18.04.2014. Alleging that no action is taken on the said applications, the present writ petition is filed.
Evidently, the petitioners have applied for ORC under the Andhra Pradesh (Telangana Area) Abolition of Inams Act, 1955 and the said applications are recently filed. The 2nd respondent being the statutory authority is required to conduct appropriate enquiry for considering the said claim of the petitioners. For conducting the said enquiry, they may have to give notices to the persons having interest including the landholder. Since elaborate enquiry is required, I deem it appropriate to dispose of the writ petition by directing the Revenue Divisional Officer – the 2nd respondent to take up appropriate enquiry after giving notice to all the concerned and take a decision on the applications of the petitioners, preferably, within six months from the date of receipt of a copy of this order. There shall be no order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
