Heard Mr. Nayab Ahmad Khan, the learned counsel for the applicants and the learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed without challenging the summoning order and without annexing the certified copy of the summoning order.
In view of the judgment of this Court in the case of Simplex Infrastructures & 4 Others Versus State of U.P. & Another in Criminal Misc. Appliction No. 14785 of 2015 decided on 27th November, 2018 reported in Laws (All) 2018 (11) 70, the present application under Section 482 Cr.P.C. is not maintainable. It is accordingly dismissed with liberty to file a fresh seeking challenge to the summoning order also.
Certified copy of the impugned order shall be returned to the learned counsel for the applicants after retaining the photo copy of the same on record.
