Heard learned counsel for the petitioner and Mr. Amit Sinha, learned A.G.A. for the State-respondents.
This writ petition has been filed by the petitioners seeking quashment of FIR dated 15.4.2019 in respect of Crime No. 161 of 2019 for the offence under Section 379 of IPC, Police Station Kotwali Dehat, District Etah.
Counsel for the petitioners submits that he is not pressing this petition on merits and is willing to face the trial. He, however, submits that interim order is operating in favour of the petitioners since 6.5.2019 and, therefore, the same may be directed to continue till filing of police report under Section 173(2) of Cr.P.C.
State counsel has no objection to this proposition.
The petition is disposed of as not pressed, directing the police to complete the investigation, if already not completed, within three months from today.
The petitioner is obliged to supply a copy of this order to the concerned SHO and also to the concerned Superintendent of Police.
State counsel may also serve the copy of this order to the respondents.
As the interim order is operating in favour of the petitioners since 6.5.2019, the same shall continue till filing of police report under Section 173(2) of Cr.P.C.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner(s) alongwith a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
