Heard learned counsel for the applicants and learned A.G.A. This application has been filed with a prayer to quash the N.B.W. dated 21.4.2010 issued by the Chief Judicial Magistrate, Farrukhabad in Case No. 12 of 2007 under sections 147,148,149,427,504 and 307 I.P.C. From the perusal of the record, it appear that due non appearance of the applicants N.B.W. has been issued, therefore, the prayer for quashing the N.B.W. dated 21.4.2010 is refused.
However, it is directed that the applicants shall appear before the court concerned within 20 days from today, till then the N.B.W. issued against the applicants shall be kept in abeyance.
In case the applicants apply for bail, the same shall be heard and disposed of expeditiously, if possible, on the same day by the courts below. With the above direction, this application is finally disposed of. Order Date :- 18.6.2010 N.A.
