THE HON'BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No.9190 of 2012 ORDER:
This revision is filed to quash proceedings in P.R.C.No.35/2011 on the file of III Additional Judicial First Class Magistrate, Rajahmundry for alleged offence under Section 32 of Drugs and Cosmetics Act, 1940 for violation of Section 18 (i) (a) read with Section 16 (i) (a) of Drugs and Cosmetics Act, 1940.
2. Heard both sides.
3. It is represented that now P.R.C is already committed and numbered as S.C.No.356/2013 and pending on the file of I Additional District & Sessions Judge, East Godavari at Rajahmundry. Considering the same, without going into the merits of the case, I feel this petition can be disposed of directing the Court below to expedite the trial of Sessions Case by giving liberty to the petitioners to urge all these grounds before the learned Sessions Judge and the learned Sessions Judge shall consider the same without being influenced by dismissal of this application.
4. It is submitted that all the petitioners are residents of Himachal Pradesh and if they are asked to appear for each and every adjournment before the trial Court even though their presence is not necessary it will cause hardship to the petitioners.
5. Considering the same, presence of petitioners is dispensed with for each and every adjournment. However, they shall appear as and when trial Court feels that their physical presence is necessary for any specific purpose.
6. With the above observation, criminal petition is disposed of.
7. As a sequel, miscellaneous petitions if any, pending in this criminal petition, shall stand disposed of.
