This application under Section 482 Cr.P.C. has been filed for quashing the entire proceeding of Criminal Case No. 94 of 2018, (State Versus Laakhan Singh and other) under Sections 323, 325, 504, 506 I.P.C., Police Station Hasayan, District Hathras, pending in the court of Additional Chief Judicial Magistrate, Hathras as well as Charge Sheet No. 14 of 2018 dated 19.01.2018 whereupon learned court concerned taken cognizance on 12.02.2018, arising out of Case Crime No. 397 of 2017.
It is urged that a suit instituted by the applicant no. 3 in 2014 is pending against the opposite party no. 2. It is further urged that a criminal complaint was filed against the opposite party no. 2 in which she was summoned in 2015. In this back drop, it is alleged that the instant complaint has been lodged as a counterblast.
Learned A.G.A. submits that the instant offence is of 2017, therefore, there is no remote possibility to link the instant complaint with the pending suit of 2014 and the complaint lodged thereafter in 2014 itself.
In the circumstances, I am not inclined to interfere with the matter.
This application under Section 482 Cr.P.C. is accordingly dismissed.
