Shri K.M.Paul, learned advocate for the petitioner submitted that the order, passed by the Labour Court, Valsad impugned in this proceeding of restoring the reference, appears to have proceeded on the footing that the workmen initially remained present but thereafter on account of various reasons including their residences in interior place and ailment, they could not remain present.
Learned advocate for the petitioner submitted that the Rojkam would indicate that the Court has not looked into this Rojkam so as to verify the claim of the workmen that they remained initially present before the Court and they were vigilantly pursuing their cause. He requests for time for producing on record the Rojkam. Time is granted. Matter, at his request, is kept on 9th September, 2009.
