Heard learned AGP Mr.Banaji for the applicants.
It has been the consistent practice of this Court not to enter into the merits of those appeals wherein the claim in appeal is petty, and claims upto Rs.1,00,000/- have been quantified by this Court as petty claims. Since the amount involved in this appeal is less than Rs.1,00,000/-, the delay caused in filing the appeal is not condoned and the application is dismissed and accordingly the appeal is dismissed without entering into the merits of the matter. It is made clear that this order will not be treated as precedent. Decree be drawn accordingly.
