ORDER:
This writ petition is filed for the following substantive relief:
“…to issue a writ, order or direction more particularly one in the nature of writ of mandamus to declare the action of respondent Nos.1 to 4 in not proceeding further on the surcharge orders RC No.195/2008/E dt.27.07.2010 against respondent Nos.5 to 10 is illegal arbitrary and violation of the provisions of Cooperative Societies Act and also in violation of provisions of the Constitution of India. Consequently direct respondent Nos.1 to 4 to take action against respondent Nos.5 to 10.”
After arguing the case, Sri P.N.Murthy, learned counsel for the petitioner, sought permission of the Court to withdraw the writ petition with liberty to the petitioner to avail appropriate remedy against the order dismissing the application filed for impleadment of the petitioner by the A.P.Cooperative Tribunal.
The writ petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the writ petition, W.P.M.P.No.32333 of 2014 shall stand disposed of as infructuous.
