HON’BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.33386 of 1998
WRIT PETITION No.2761 of 2002 WRIT PETITION No.2033 of 2003 WRIT PETITION No.19632 of 2001
and
WRIT PETITION No.13864 of 2011 COMMON ORDER:
The petitioners in all these writ petitions claim to be purchasers of individual plots of land in Survey Nos.250 to 260 and 263 to 304 of Karmanghat Village, Saroornagar Mandal, Ranga Reddy District, purchased under a sanctioned layout from Karmanghat Gram Panchayat vide File No.3/4/1580 dated 16.08.1980 made by the original owners. It is not necessary to trace out the history leading to filing of the present writ petitions in view of the limited relief sought in the writ petitions and disposal of the same.
2. The petitioners claim that the respondents, in a hurried manner, are resorting to encroach upon the plots of the petitioners high handedly in the name of laying Necklace Road in the adjacent Saroornagar Tank by disturbing the possession of the petitioners without following due process of law. This Court earlier granted interim orders in these writ petitions by virtue of which the possession of the petitioners is protected.
3. In the circumstances, these writ petitions are disposed of directing the respondents not to interfere with the possession of the petitioners’ land except in accordance with law. If the title of the petitioners is subsequently held to be invalid by any competent court of law, the petitioners also shall be notified of the same by the competent authorities before taking any action for possession of the land for any public purpose. Pending miscellaneous petitions in all these writ petitions, if any, shall stand dismissed in consequence. No costs.
