4. Ramesh Sardar Singh ...Respondents The Civil Revision Petition is filed under Article 227 of the Constitution of India, to set aside the order dated 06.02.2017 in the memo filed by the petitioner in OS.No.6716/2013 passed by the XV Assistant City Civil Court at Chennai.
For Petitioner : Mr.S.Sethuraman ORDER The plaintiff in O.S.No.6716 of 2013 on the file of XV Assistant Judge, City Civil Court, Chennai, has filed the above Civil Revision Petition, challenging the order dated 06.02.2017 passed in memo in O.S.No.6716 of 2013.
2. The plaintiff filed a memo dated 06.02.2017 for posting the suit for cross examination.
3. The Trial Court rejected the memo stated that the suit cannot be posted for cross examination of PW1, since several applications are pending.
4. Mr.S.Sethuraman, learned counsel appearing for the petitioner submitted that the suit was filed in the year 2013 and even after nearly four years, the suit has not yet been disposed of.
5. In view of the submissions made by the learned counsel appearing for the petitioner, without expressing any opinion with regard to the merits of the case, I direct the XV Assistant Judge, City Civil Court, Chennai, to dispose of the suit in O.S.No.6716 of 2013, on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order. Since the Trial Court has observed that the Interlocutory Applications are pending, the Trial Court is directed to dispose of all the pending Interlocutory Applications on or before 28.04.2017.
With these observations this Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
