For Petitioners : Mr.S.Sankar For Respondents : Mr.C.Emalias, Addl. Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondents not to harass the petitioners and also not to interfere with the civil matters between the parties.
2. It is the case of the petitioners that they had settled the property in S.No.33/1 & 2 at Moorthiganadinna Village, Bagalur Post, Hosur Taluk and Krishnagiri District in favour of their children way back in the year 1994. While so, one Balakrishna Reddy claiming to be the purchaser of the said property, had disturbed the children of the petitioners, who in turn, filed a suit in O.S.No.427 of 2005 before the District Munsif, Hosur seeking declaration and other consequential reliefs and the suit is pending adjudication. Be that as it may, one Moorthy, PA of the said Balakrishna Reddy, stated to have filed a complaint against the petitioners herein to the respondents alleging land grabbing. Based on the said complaint, the respondent police have repeatedly threatened the petitioners to settle the dispute with the parties. Hence, this petition.
3. Learned counsel for the petitioners submitted that the dispute between the parties is more of civil in nature. However, the respondents are harassing and threatening the petitioners to settle the matter with the complainant.
4. On the other hand, learned Additional Public Prosecutor, on instructions, submitted that there was no such harassment or threat caused by the respondents, as alleged by the petitioners. Learned Additional Public Prosecutor further submitted that the petitioners were only directed to produce the documents relating to the property in question, but they failed to do so.
5. The submission so made by the learned Additional Public Prosecutor is recorded. In order to give quietus to the issue, this Court directs the petitioners to appear before the second respondent on 03.04.2017 and produce all the necessary documents relating to the property in question. It is made clear that the second respondent shall not harass the petitioners in the mean while.
