(SHOW CAUSE NOTICE BEFORE ADMISSION) IN THE HIGH COURT OF JUDICATURE OF ANDHRA PRADESH AT HYDERABAD FRIDAY, THE NINTH DAY OF MAY TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION :5112 of 2014 Between:
L.Rameshwar reddy S/o. Narasimha Reddy, AND . Petitioner The State of A.P. Spl. Public Prosecutor, (Directorate of Revenue Intelligence) Hyderabad . Respondent Whereas the Petitioners above named through their Advocate SRI D. SURYANARAYANA, presented this petition under Section 482 of Cr.P.C. praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to quash the proceedings in Sessions Case No.491 of 2013, pending on the file of the Metropolitan Sessions Judge, Hyderabad holding the same as per illegal and abuse.
And whereas, the High Court upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI D. SURYANARAYANA, Advocate for the Petitioner and of the ANIL PRASAD TIWARI, Spl Public Prosecutor, on behalf of Respondent, directed issue of notice to the Respondent herein to show cause why this petition should not be admitted.
You viz :
The Intelligence Officer, Directorate of Revenue Intelligence, Hyderabad are directed to show cause as to why in the circumstances set out in this petition and the memo of grounds filed therewith (copy enclosed) this Criminal Petition should not be admitted.
The Court made the following ORDER:
This petition is filed under section 482 Cr.P.C. to quash the proceedings in Sessions Case No.491 of 2013 pending on the file of the Metropolitan Sessions Judge, Hyderabad, for the offences under Sections 22, 28 and 29 of the N.D.P.S. Act.
The petitioner is questioning the validity of search conducted under Section 41 of the N.D.P.S. Act.
The trial of the case is already commenced and three witnesses were already examined in chief. At this stage, the petitioner approached this Court to quash the proceedings.
Notice before admission.
List the matter after Summer Vacation, 2014.
