This Writ petition is filed under Articles 226 and 227 of Constitution of India, praying to quash the order dated 28.08.2014, vide Annexrue-G passed by the Court of the Principal Senior Civil Judge and CJM at Davanagere in O.S.No.111/2010 on I.A.Nos.12 and allow said IA.Nos.12 by granting the reliefs prayed for therein.

Notice to R2 and R4 served and unrepresented) These Writ petitions are filed under Articles 226 and 227 of Constitution of India, praying to quash the order dated 19.06.2014, vide Annexure-L passed by the Court of the Principal Senior Civil Judge and CJM at Davanagere in O.S.No.111/2010 on I.A.Nos.10 and 11 and allow said IA.Nos.10 and 11 by granting the reliefs prayed for therein.
These petitions coming on for Preliminary Hearing- B Group, this day, the Court made the following:
ORDER Learned counsel for the petitioners files a memo seeking leave to withdraw the petition with liberty to assail the impugned orders in the event of plaintiffs-
petitioners not succeeding in the suit and appeal being filed.
The said memo is placed on record.
Writ petitions are dismissed with liberty to petitioners urge all such grounds as is available under law in the appeal that may be filed in the event of plaintiffs–petitioners not succeeding in the suit. Contentions of both parties are left open.
In view of dismissal of writ petitions, IA.No.1/2017 in W.P.Nos.32145-146/2014 does not survive for consideration and hence, it is rejected.
