2. Admittedly petitioner's appeal is pending before Real Estate Appellate Tribunal and the Stay Application pending before Tribunal is fixed on 06.03.2019. Recovery in question is nothing but a consequential action in respect to cause of action for which appeal is pending.
3. Since petitioner has already availed statutory alternative remedy, writ petition challenging the consequential action is not maintainable.
4. Dismissed accordingly.
