Pursuant to the order passed by this Court, a supplementary affidavit has been filed today, the same is taken on record.
Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not issue to the private-respondent.
The petitioner is before this Court for a direction to the court below to decide the Execution Application No. 11 of 2021 (M/s Kwality Leather Industries and another Vs. M/s Shakti Corporation and another under Order XXI, Rule XI and U/s 36 Arbitration and Conciliation Act, 1996, within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
