The petitioner, who has prior approved service in the third respondent's school, was appointed as HSA (English) as per appointment order dated 3.6.2013. A proposal to approve the said appointment order was also forwarded to the District Educational Officer, Irinjalakuda. While the proposal was pending, the Manager attempted to appoint the fourth respondent, who is working in the school as UPSA as HSA (English). The petitioner thereupon submitted Ext.P8 representation dated 15.5.2014 before the Deputy Director of Education, Thrissur to prevent such appointment. The instant writ petition was thereupon filed on 6.6.2014 seeking the following relief: “(i) Issue a writ of mandamus or any other appropriate writ, order or direction directing the 2nd respondent to approve the appointment of the petitioner as HSA (English) with effect from 3.6.2013 in the retirement vacancy of K.J.Mercy and retain her in the said post/or in the alternative direct the respondents 1 and 2 to dispose of Ext.P8, after affording an opportunity of hearing to the petitioner and respondents 3 and 4 forthwith.”
2. When the writ petition came up for hearing on 9.6.2014, it was adjourned to this day with a direction to the learned Government Pleader to get instructions. When the writ petition came up for W.P.(C) No.14434/2014 2 hearing today, learned Government Pleader submitted on instructions received from the District Educational Officer, Irinjalakkuda, that orders have been passed on 2.6.2014 declining to approve the petitioner's appointment. Such being the situation, I am of the opinion that the petitioner should challenge the order passed by the District Educational Officer, Irinjalakkuda declining to approve her appointment before the competent appellate authority in appeal and seek appropriate interim orders. Without prejudice to that right, this writ petition is closed.
