The learned counsel for the appellant submitted that the appellant may be permitted to withdraw the appeal. It is submitted that in this appeal on 24.09.2010, an order was passed by this court directing the appellant to provide a Fixed Deposit in his name drawn on a Nationalized Bank for an amount of ` 3 lakhs and the appellant may be permitted to withdraw the said amount after obtaining the receipt from the court below.
Therefore, we dismiss the appeal as withdrawn and the appellant is permitted to collect the Fixed Deposit receipt and get the amount lying in Fixed Deposit. The parties will bear their costs in the appeal.
