K.Vijayan vs Ramanattukara Grama Panchayath

High Court Of Kerala|22 November, 2014
|

JUDGMENT / ORDER

The petitioners, residents of the respondent Panchayat, complain of traffic congestion caused by the functioning of unlicensed shops from the sides of Ramanattukara - Farook College road. Relying on information obtained under the Right to Information Act, 2005, the learned counsel for the petitioners points out that, the shops have admittedly not been issued with any licences to conduct business. Therefore, there is absolutely no justification for permitting them to continue their activities to the detriment of public interest.
2. Adv.Sri.P.B.Krishnan appears for the respondent. The learned counsel submits that, since the petitioners have already approached the Panchayat with Ext.P11 representation, the Panchayat would consider the same and initiate appropriate action in the matter.
In view of the above submission, this writ petition is disposed of directing the respondent to consider the grievances of the petitioners set out in Ext.P11 representation, in accordance with law, after affording an opportunity of being heard to the petitioners as well as the shop owners who are the persons affected and to W.P.(C) No.29571 of 2013 2 pass appropriate orders thereon, as expeditiously as possible and at any rate within a period of one month of the date of receipt of a copy of this judgment.
