Petitioner claims to be owner in possession of one acre of land in resurvey No.12/1B of Thiruvally Village, Ernad Taluk. Petitioner purchased this property from a declarant in S.M.P.No.16 of 1997 of Taluk Land Board, Nilambur. It seems ceiling proceedings are pending against the property. The revenue officials refused to receive basic tax from the petitioner. Petitioner has a case that his property is not form part of ceiling proceedings.
2. Petitioner has also a case that he has not purchased the property from the declarant. I am not entering into those disputed facts. Admittedly, ceiling proceedings are not over and properties have not been ordered to be restored to the Government.
3. In view of the above, basic tax shall be received from the petitioner. However, it is made clear that this will be subject to any ceiling proceedings initiated against the petitioner.
The Writ Petition is disposed of as above.
