K.Varadharajan vs The District Registrar

Madras High Court|27 November, 2017

JUDGMENT / ORDER

The petitioner seeks for a mandamus directing the respondent to consider and dispose of his representation dated 08.08.2017 in terms of Circular No.67 dated 03.11.2011.
2. Heard the learned counsel for the petitioner and perused the representation of the petitioner dated 08.08.2017. K.RAVICHANDRABAABU,J.

3. This Court is not inclined to entertain this writ petition for two reasons. Firstly, the Circular, which is sought to be relied on by the petitioner viz., the Circular No.67 dated 03.11.2011, is recently withdrawn by the Department through his proceedings dated 20.10.2017. Apart from the said fact, a perusal of the representation given by the petitioner would show that he is seeking to set aside a document executed as early as in the year 1936 by the son of one Valliammal. I do not think that the petitioner can make such representation to set aside a document executed as early as in the year 1936, based on the said Circular, which is also withdrawn by the Department recently. I am of the considered view that the petitioner is trying to give life to a deadwood after a period of 91 years which cannot be encouraged by means of such representation. Accordingly, I find no merits in this writ petition and the same is dismissed. No costs.
