JUDGMENT / ORDER

ANTONY DOMINIC, J.
The petitioner challenges the order passed by the Kerala Administrative Tribunal in O.A.No.1385 of 2014.
2. The Original Application was filed, aggrieved by the inaction of the Government on Annexure-A13 representation made by him requesting for transfer back to Thrissur. By the impugned order the Tribunal disposed of the Original Application directing that the order shall be passed on Annexure-A13. It is this order which is challenged in this O.P.
3. The petitioner was posted at Thrissur as Deputy Collector (LR & AA). While so, on account of the general elections the petitioner was transferred and posted to Calicut as Deputy Collector (Disaster Management). According to him, though the election is over and all others are transferred back, he alone was retained at Calicut. He also alleges that his transfer was against Annexure-A8 guidelines.

4. Considering the case of the petitioner that other officers transferred along with him were re-transferred and that he alone was discriminated, this Court passed an order dated 22nd September, 2014 directing the Government Pleader to obtain instructions in the matter.

Accordingly instructions were obtained by the Government Pleader which show that the transfer of the petitioner from Thrissur to Calicut was on account of the general election and that, though some officers were re- transferred, it is not correct to contend all were re-transferred as claimed by the petitioner. It is also stated that the Government have received several complaints against the petitioner not only from his superior officers but also from the general public and it was therefore that the Government thought that it is not desirable to post the petitioner again to Thrissur.
These facts now disclosed by the Government Pleader show that there is nothing arbitrary or malafide either in transferring the petitioner to Calicut or in not re-transferring O.P.(KAT)No.310 of 2014 3 the petitioner to Thrissur. In such circumstances and as the instructions received by the learned Government Pleader itself shows that the Government are taking action for passing orders on Annexure-A13 as directed by the Tribunal, we dispose of the O.P.(KAT) with a direction that such orders shall be passed, as expeditiously as possible, on the production of a copy of this judgment.
