JUDGMENT / ORDER

Rule.
The present Civil Application has been filed by the Applicant for being joined as the heir and legal representative of deceased Plaintiff - Hina Vora. The death certificate is also produced. It is also stated that the deceased Hina Vora died intestate and has left the Applicant - mother as she was unmarried and therefore the Applicant is the heir as per the provisions of the Hindu Succession Act.
Heard learned Advocate Mr. Amar N.Bhatt for the Applicant and learned Advocate Ms. Shah for the Respondent.
In the facts and circumstances, the present Application deserves to be granted as the Applicant is the heir of deceased Plaintiff - Hina Vora as per the provisions of the Hindu Succession Act and therefore the present Application deserves to be allowed and accordingly stands allowed.
Prayer in terms of paragraph 4(A) is granted. Learned Advocate is directed to carry out the amendment by substituting the name of the Applicant in place of the original Appellant in the main matter - First Appeal No.4408 of 1996.
The present Application stands disposed of accordingly. Rule is made absolute.
The main matter be placed on board on 17.2.2012.
