JUDGMENT / ORDER

1. The petitioner by way of this petition under Article 226 of the Constitution of India has prayed for the following reliefs :
"(A) Directing the Respondents to modify the orders dt.1.10.2002 and 25.11.2003 and grant the higher grade scale to the petitioner with effect from 20.8.1991 instead of 28.2.1995 by restoring the order dt.27.8.2001 and further revise her pay accordingly and pay arrears with interest.
(B) During the pendency and final disposal of this petition, the Respondents may be may be restrained from affecting any recovery from the petitioner.
(C) During the pendency and final disposal of this petition, the Respondents may be directed to reconsider the case of the petitioner for higher grade scale in light of the judgment dt.18.2.2010 passed in Special Civil Application No. 324 of 2010 and judgment dt.6.8.1999 passed in Special Civil Application no. 8181 of 1998.
(D) To grant such and further relief as may be deemed fit and proper".
2. Pursuant to the order of 28.12.2011 the State of Gujarat in Human and Child Development Department has passed an order dated 18.1.2012 whereby the respondent authority has granted benefit of first higher pay grade on the date on which the petitioner has completed 9 years from the date of appointment. A copy of the order dated 18.1.2012 tendered by Ms. Punani, learned Assistant Government Pleader is taken on record.
3. It would be evident from Annexure-1 to the said order dated 18.1.2012 that in case of the petitioner in column no.4 date of appointment is mentioned and in column no.5 the date on which the petitioner has completed 9 years from the date of appointment is mentioned and in column no.6 the date on which the petitioner is entitled to higher pay grade is mentioned.
4. In view of the order dated 18.1.2012 the grievance of the petitioner stands redressed. The petition is disposed of accordingly. Notice discharged with no order as to costs.
