JUDGMENT / ORDER

Court No. - 43
Case :- CRIMINAL MISC. BAIL APPLICATION No. - 23026 of 2014 Applicant :- Smt. Kusum Opposite Party :- State Of U.P.
Counsel for Applicant :- Anurag Pathak,Sangam Lal Kesarwani Counsel for Opposite Party :- Govt. Advocate,Pankaj Bharti
Hon'ble Pradeep Kumar Singh Baghel,J.
This bail application has been moved by the applicant- Smt. Kusum seeking bail in Case Crime No. 24/155/13, under Sections 364, 302, 201 I.P.C., Police Station Jhinjhana, District Prabuddh Nagar (Shamli). Her first bail application has been rejected by this Court vide order dated 07th January, 2014.
Learned counsel for the complainant states that the trial is at the fag-end as four witnesses of facts have been examined and the trial is likely to be concluded in a short period.
Heard learned counsel for the applicant, learned A.G.A. and learned counsel for the complainant and perused the record.
Having heard learned counsel for the parties, I am of the view that there is no ground to allow the bail application as no new ground has been made out.
However, having regard to the facts that the applicant is a lady and she is in jail since 20th March, 2013, in my view, the ends of justice would be subserved by issuing a direction upon the trial Court to conclude the trial expeditiously, preferably within a year subject to the condition that both the parties will not take any unnecessary adjournment, as has been assured by learned counsel for both the parties.
With the aforesaid observations, the bail application stands disposed of.
