1. Heard Sri Vinod Kumar Pandey, learned counsel for the petitioner; Sri Sunil Kumar Singh, learned counsel appearing for the Gaon Sabha and learned Standing Counsel for the State-respondents.
2. Solitary grievance of the petitioner appears to be that her partition suit being Case No. 222 of 2006 (Rajendra Kant Vs. Smt. Kusum Lata & Ors.), wherein the petitioner is a respondent, filed under Section 176 of U.P.Z.A. & L.R. Act, before respondent no.2-District Magistrate, Prayagraj, has remained pending since 2006. Referring to the ordersheet, it has been submitted that the delay is not attributable to parties but on account of routine dates being fixed and the matter has not been effectively proceeded with.
3. Without entering into the merits of the case, the present writ petition is disposed of with a direction to the respondent no.2-District Magistrate, Prayagraj, to decide the aforesaid case, as expeditiously as possible, strictly in accordance with law, preferably within a period of six months from the date of production of a copy of this order, if there is no legal impediment provided the petitioner does not seek any adjournment during that period and cooperates in the proceedings.
