Heard learned counsel for the petitioner, Ms. Suman Jaiswal, learned counsel for respondents No. 1, 2 and 3 and learned Standing Counsel for respondents No. 4 and 5.
The present petition has been preferred for the quashing of the order dated 06.11.2019 passed by the Deputy Chief Controller of Explosives for and on behalf of Joint Chief Controller of Explosives, Central Circle Office, Agra and the consequential order dated 23.10.2019 of the District Magistrate.
The license of the petitioner to sell crackers has been cancelled by the aforesaid orders.
The petitioner can challenge the said order by way of an appeal under Rule 121 of Explosives Rules, 2008.
In view of the statutory remedy available to the petitioner, we refuse to exercise our discretionary jurisdiction.
The writ petition is dismissed with liberty to avail the remedy of appeal.
