The petitioner is a Staff Nurse. She has been transferred from Gorakhpur to Trama Centre, Basti. The petitioner has challenged the said transfer order on the ground of her personal hardship. It is averred in the writ petition that one of her son is studying in the High School and her daughter is a student in the Deen Dayal University, Gorakhpur. She has also made a statement in paragraph no. 9 of the writ petition that her husband has heart ailment and he is under treatment at District Hospital, Gorakhpur.
From the record, it appears that for redressal of her grievance, she has made a representation to the authority concerned on 07.5.2016. Ordinarily, the Court does not interfere in the matter of the transfer unless there is statutory violation. However, in view of the fact that the petitioner has personal hardship and she has made a representation, the end of justice requires that her representation be considered objectively and appropriate order be passed within three months from the date of communication of this order.
Till the decision on the representation, the effect and operation of the transfer order dated 25.04.2016 passed by respondent no.2 as it relates to the petitioner shall be kept in abeyance.
In view of the aforesaid, the writ petition is finally disposed of.
