Heard learned counsel for the applicant and learned AGA for the State.
By means the present application, the applicant has invoked the inherent jurisdiction of this Court to expedite the hearing of the complaint case no. 3744 of 2015, under Section 138 NI Act pending in the Court of A.C.J.M. VIIIth Kanpur Nagar.
Learned counsel for the applicant submitted that the applicant has come before this Court with the same prayer to expedite the trial in three occasion, left with no option, applicant has filed contempt petition bearing no. 5463 of 2017 which is still pending.
Learned counsel for the applicant submitted that though the matter is heard but matter has not been decided by learned Magistrate.
Under the circumstances, I am no inclined to pass any other direction to learned Magistrate in this regard, if the applicant so desires, he may raise his grievance before appropriate forum by filing a remedy available under the law.
With the aforesaid observation this application is disposed of.
