The defendant in O.S.No.69 of 2004 on the file of the Court of the Subordinate Judge, Muvattupuzha is the appellant. The said suit was one for realisation of money. As per the decree and judgment impugned in this appeal, the respondent was permitted to recover a sum of Rs.2,07,600/- from the appellant with interest and costs.
2. In the course of the proceedings, the parties were referred for mediation and the matter has been settled at the mediation. The memorandum of settlement arrived at between the parties at the mediation is part of the records. We have perused the terms of settlement and we are satisfied that the terms of settlement are lawful.
3. In the circumstances, the judgment and decree impugned in this appeal are set aside and the appeal is disposed of in terms of the settlement. In view of Section 69A of the Kerala Court Fees and Suits Valuation Act, the court fee paid on this appeal shall be refunded to R.F.A.No.410 of 2008 2 the appellant. A copy of the memorandum of settlement shall be appended to this judgment and the original shall be preserved.
