Kurjibhai vs Girdharbhai

In this writ petition challenge is made to the order of denial of issuance of witness summons. It appears that identical applications have been made in past twice. The trial Court in Special Civil Suit No. 1 of 2002, while rejecting the said Application made below Exh. 128 opined that this is nothing but an attempt to delay the further proceedings. Earlier rejection of applications Exh. 112 & 114 have not been challenged. The order impugned, therefore, requires no interference. Writ petition stands disposed of. No costs.
