HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 16421 OF 2008 ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
This Writ Petition was filed challenging the action of respondents in not granting quarry lease for road metal to the petitioner in respect of the land to an extent of Ac.5.00 cents in Block No. 28 of Petasannigundla village, karampudi mandal, Guntur District.
The learned Government Pleader produced a copy of the written instructions received by him from the respondents, wherein it is stated as follows:
“ This office basing on the above reports has submitted the proposals to the Deputy Director of Mines and Geology, Guntur for grant of quarry lease for road metal over an extent of Ac.5.00 cents in Block No.28 of (Singarutla Agraharam) Petasannegandla village, Karampudi Mandal of Guntur District for a period of 10 years vide this office single file system No.3003/Q/2008, dated 18.08.2008. The orders are awaited from the Deputy Director of Mines and Geology, Guntur. The Deputy Director of Mines and Geology, Guntur vide proceedings No.5245/ /2008, dated 27.09.2008 granted a quarry lease in favour of the petitioner for quarrying of road metal, over an extent of 2.023 hectares (5.00 acres) in Bock No.28 (Part) Singarutla Agraharam Temple Lands, Petasannigundla village, Karampudi mandal of Guntur District for a period of 10 years subject to the conditions that the petitioner should produce NOC from Endowment authorities from time to time. Accordingly the petitioner executed the quarry lease deed and the Assistant Director of Mines and Geology, Dachepalli issued work orders vide Proc.NO.5951/Q/2008, dated 06.11.2008 to commence the quarrying operations in the subject area with effect from 06.11.2008 to 05.11.2018. After wards, the petitioner is conducting the quarry operations by obtaining the dispatch permits from the office duly paying the required seig. Fee as per the rules in vogue from time to time.”
In view of the above, the cause in the matter does not survive and no further orders need be passed in the Writ Petition.
The Writ Petition is dismissed as having become infructuous. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
