Civil Revision Petition is filed under Section 115 Code of Civil Procedure to direct the Subordinate Judge, Tambaram to dispose of the Execution Petition in E.P.No.129 of 2015 in O.S.No.535 of 2009 pending on the file of Subordinate Judge, Tambaram.
For petitioners: Mr.R.Sugumaran ORDER The petitioners have filed this Civil Revision Petition to direct the Subordinate Judge, Tambaram to dispose of the Execution Petition in E.P.No.129 of 2015 in O.S.No.535 of 2009 pending on the file of Subordinate Judge, Tambaram.
2. The counsel for the petitioners would submit that the petitioners have filed an application in E.P.No.129 of 2015 on the file of Subordinate Judge, Tambaram to execute the final decree passed in O.S.No.535 of 2009 and the Execution Petition, without passing an order, has been adjourned from time to time without any adjudication only on the request of the respondent. Hence, the petitioner has filed this Civil Revision Petition before this Court praying to direct the Court below to dispose of the above Execution Petition.
3. Heard, the counsel for the petitioner and perused, the materials.
It is seen from the detailed extract furnished by the petitioner in the type set of papers that an application in E.A.No.161 of 2016 has been filed by the respondent which is pending for disposal. At this stage, the present Civil Revision Petition has been filed by the petitioner to dispose of the above application in E.P.No.129 of 2015 .
4. Without considering the facts and circumstances of the case, taking into consideration that the petitioner being a senior citizen, with out going into the merits of the case, the learned Subordinate Judge, Tambaram is directed to dispose of E.A.No.161 of 2016 as expeditiously as possible, in accordance with law, preferably within a period of eight weeks from the date of receipt of a copy of this Order.
5. The Civil Revision Petition is disposed of with the above direction.
Consequently, the connected Miscellaneous Petition is closed. No Costs.
