Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with the prayer staying the arrest of the petitioner during the investigation of Economic Offences Case No. 20 of 2012, Economic Offences Wing, Meerut in case crime no. 135 of 2009, u/s 420, 467, 468, 471, 406 IPC, P.S. Sarsawa, district Saharanpur.
Learned counsel for the petitioner submits that the present case is of the year 2009. The investigation of the case was entrusted to Economic Offence Wing in the year 2012 but the investigation of the case has not been concluded till date. He further submits that in the identical matter, accused has preferred Criminal Misc. Writ Petition No. 6020 of 2011 in which interim protection has been granted in their favour on 19.7.2012 by coordinate Bench of this Court.
Considering the facts of the case and the submissions made by learned counsel for the parties, we direct the Investigating Agency of the case to conclude the investigation of the case within the period of four weeks from today who shall file report to the Magistrate concerned in accordance with the provisions of law.
It is further directed that the petitioner shall not be arrested in above mentioned case, till submission of the police report under section 173(2) Cr.P.C.
The S.P/S.S.P, Saharanpur is directed to ensure the compliance of this order.
With the aforesaid directions, the present petition stands disposed of.
