Heard learned counsel for the parties.
The petitioner is before this Court with request to issue direction to the second respondent i.e. District Basic Education Officer, Jaunpur to release his salary as Class-IV employee in Kisan Poorva Madhyamik Vidyalaya Itaili Gajna, Kudda, Jaunpur alongwith arrears from the date of his initial joining i.e. 15.7.2004.
Learned counsel for the petitioner states that the petitioner has already filed a representation dated 6.9.2017 before the District Basic Education Officer, Jaunpur for redressal of his grievance, which is still pending. He has confined his prayer only to the relief that his representation dated 6.9.2017 may be considered by the appropriate authority.
Shri Mrigraj Singh, learned counsel for the respondent.2 has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the District Basic Education Officer, Jaunpur to decide the petitioner's representation in accordance with law after according opportunity of hearing to the Committee of Management/Headmaster of the institution in question within a period of two month from the date of production of a certified copy of this order before him.
