Heard the learned counsel for the parties.
Petitioner, a Head Constable, retired on 31 January 2018 on attaining the age of superannuation. By the impugned order dated 2 April 2019 passed by the fourth respondent- Additional Superintendent of Police, Moradabad, directing the petitioner to vacate the government premises No. C- 175, Reserve Police Line within five days.
Learned counsel for the petitioner submits that the petitioner seeks further 12 months to vacate the premises.
This Court in exercise of its discretionary jurisdiction under Article 226 of the Constitution declines to interfere in the impugned order.
The writ petition is, accordingly, dismissed.
Petitioner to vacate the premises forthwith failing which it will be open to the respondents to charge/recover penal rent in accordance with the Rules/Government Order.
