1. Heard learned counsel for the applicants and learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicant Kunwar Pal Singh, Bhanwar Singh, Ajit and Sunil, seeking anticipatory bail in Case Crime No. 63 of 2021, under Sections 308, 323, 324, 504, 506 IPC, Police Station- Achhnera, District Agra during pendency of trial.
3. In view of the specific allegation with respect to the alleged offence under Section 308 IPC having been made in the FIR constituting serious offence as disclosed, at present, it is difficult to exercise discretion for grant of anticipatory bail in favour of the applicants.
4. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicants to apply for regular bail, which application when filed may be considered, on its own merit as expeditiously as possible, without being prejudiced by any observation made in this order.
