Heard Shri Anand Mani Tripathi, learned counsel for the petitioner.

Shri Ashok Kumar Verma, learned counsel appearing for respondent nos.2 and 4 has raised a preliminary objection regarding the maintainability of the writ petition. He has submitted that against the order impugned in the present writ petition the petitioner has already filed an appeal, which is still pending. The counsel submits that the petitioner cannot be permitted to pursue two remedies simultaneously.

As prayed by the learned counsel for the petitioner, put up this case on 23.12.2021 as fresh.
