1. Vide order dated 3.5.2012 this Court had passed the following order :
"By an order dated 1.5.2012, the respondent was directed to file an undertaking as per the statement made by learned advocate Mr. Bhavesh Choksi for Nanavati Associates latest by 2.5.2012. Mr. Bhavesh Choksi, made a statement on instructions that the remaining amount due to the petitioner shall be paid in equal monthly installments of Rs.15,000/-. As no undertaking is filed, the authorised person of the respondent is hereby directed to remain personally present before this Court on the next date of hearing i.e. on 7.5.2012. Time to file an undertaking is extended till 7.5.2012. S.O. to 7.5.2012."
2. Mr.
Bhavesh Choksi, learned Counsel appearing for Nanavati Associates for respondent states that the authorized person of the respondent Company is out of station and Mr. Choksi had received e-mail from him requesting him for further time. As such no leniency is required to be shown to the respondent Company as he has not cared to respond the statement made on his behalf by Mr. Choksi, learned Counsel and under one pretext or the other is not remaining present before this Court. It is also noticed that earlier statement made on behalf of the respondent Company as regards filing of undertaking to pay Rs.15,000/- p.m. is also not filed till date. However, considering the fact that such a statement was made; in the interest of justice the matter is adjourned to 12.6.2012. The authorized person of the respondent is directed to remain personally present on the said date of hearing and file the undertaking as per earlier orders dated 3.5.2012 & 1.5.2012 latest by 11.6.2012.
