This writ petition has been filed seeking the following relief:-
"(a) to issue a writ, order or direction in the nature of mandamus directing the respondent no. 2/Tehsildar, Tehsil Padrauna, District Kushinagar to decide the Case No. 965/2003-04, under Section 34 L.R. Act, (Habib Versus Karamtalli), of Mauja Madhi Mathiya, Tappa Dandopur, Pargana Sidhuwa Jobana, Tehsil Padrauna, District-Kushinagar, pending before him, within stipulated period which Hon'ble Court may deem fit and proper."
The grievance of the petitioner is that his mutation application filed under Section 34 of the U.P. Land Revenue Act in the year 1994 has not been decided finally till date.
The writ petition is disposed of directing the respondent no. 2 to decide the mutation case positively within a period of eight weeks from the date a certified copy of this order is filed before him. In case, necessity arises matter shall be heard on day to day basis so as the final order be passed within the time specified above.
