This application under Section 482 Cr.P.C. has been filed for prayer to quash/stay proceedings of Case No.4044 of 2017 (Case Crime No.0172 of 2017) under Section 3/25 Arms Act, Police Station-Jamunapar, District Mathura, pending in the Court of A.C.J.M. IVth Mathura.
Learned counsel for the applicant submitted that applicant is innocent and has not committed any offence as alleged by prosecution. At the time of occurrence he had valid licence and charge sheet has been filed against him illegally.
Matters requires consideration.
Notice on behalf of O.P. No.1 has been accepted by learned A.G.A.
Issue notice to O.P. No.2, returnable within three weeks'.
Counter affidavits may be filed by opposite parties within three weeks'.
List thereafter.
Till the next date of listing, further proceedings of Case No. 4044 of 2017, (Case Crime No.0172 of 2017) under Section 3/25 Arms Act, Police Station-Jamunapar, District Mathura shall remain stayed.
