JUDGMENT / ORDER

Petitioner approached the Local Level Monitoring Committee to correct details in the draft data bank in respect of property situated in Survey No.75/12/3 of Kunnamkulam Village in Thrissur district. According to the petitioner, this property is a dry land. According to the petitioner, this property is converted long before the enactment of Kerala Conservation of Paddy Land and Wet Land Act, 2008 and it can be identified as a dry land. However, it is submitted that without verifying the actual nature of the property, this property is classified as nilam in the draft data bank.
2. I am of the view, petitioner has a remedy before the Local Level Monitoring Committee. Petitioner shall approach the first respondent for correcting details in the draft data bank. If the petitioner approaches the first respondent within two weeks from the date of receipt of a copy of this judgment, first respondent shall conduct local inspection and find out whether this can be classified as nilam as on the date of enactment of Act 28 of 2008. If it is found that it cannot be classified as nilam as W.P(C).No.30789 of 2014W 2 on the date of enactment of Act 28 of 2008, necessarily corresponding changes has to be made in the draft data bank. Needful shall be done within a period of six weeks from the date of receipt of such application from the petitioner.
The Writ Petition is disposed of as above.
