The petitioner challenges the order Ext.P6 by which the learned Munsiff had refused to remit the Commission Report, on an application filed for the same. Definitely, at the time of trial the Commissioner would be examined and if on such evidence and also considering the objections of the petitioner herein, the learned Judge is of the opinion that further inspection to gather more details are necessary, then definitely, the Commission Report could be remitted at that stage, and such consideration shall be made dehors, the findings in Ext.P6 order. With the above observations, the Original Petition is closed.
