Heard learned counsel for the petitioner as well as Sri B.K. Ojha, learned counsel who has filed his vakalatnama on behalf of the respondent no. 2 and perused the record.
Present petition has been filed with a prayer that the Court below i.e. Additional Civil Judge (SD) Court No. 14, Prayagraj/Allahabad be directed to expedite the hearing and decide the Original Suit No. 96 of 2015 within a time bound period.
Admittedly, the suit is of the year 2015. As such, I am not inclined to issue any direction as has been prayed for.
In the facts and circumstances of the case, the present petition is finally disposed of with liberty to the petitioner to move appropriate application before the Court below for expeditious disposal of the suit, which shall be considered and decided sympathetically as learned counsel for the petitioner states that his possession is likely to be disturbed by the plaintiff.
However, it is made clear that in case any adjournment is sought by either of the parties, the same may be allowed only after recording reasons and imposing heavy cost.
With the aforesaid observations/ directions, the present petition is finally disposed of.
