Learned counsel for the petitioners asserts that the respondent-complainant has indulged in vexatious litigation only so as to harass the petitioners. The proceedings are in abuse of process of the court and process of law.
It has been pointed out that the civil court decided a dispute in regard to property vide judgment dated 23.1.2012, which has been placed on record as Anexure-8. Once the title has been decided in favour of the petitioners, in counterblast and so as to harass the petitioners the impugned proceedings have been initiated.
Considering what has been held by the civil court at running page-75 of the paper-book under Issue No.7, issue notice to the respondents for 10.7.2012.
List on 10.7.2012.
In the meantime, further proceedings shall remain stayed till next date of listing.
