Learned counsel for the petitioners may implead the Court during the course of the day.
The prayer of the learned counsel for the petitioners is that the release application under Section 21 of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, be decided within the time stipulated by the Statute.
Learned counsel for the petitioners relies upon a judgment of this Court in Manju Devi (Smt.) vs. Additional District Judge VIII, Allahabad & Ors., reported in 2007 (4) AWC 3403 wherein it has been held that when a statutory period had been provided within which the Prescribed Authority had to dispose of the Release Application then the same should be decided within that period.
Having considered the submission made by the learned counsel for the petitioners and also having considered the fact that the release application is pending since 2011, I am of the view that the release application being P.A. Case No.57 of 2011 (Krishan Kumar Bansal (Since Deceased) & Ors. Vs. Smt. Kunta Devi & Anr.) may be decided within a period of four months from the date of production of a certified copy of this order, if there is no other legal impediment. No unnecessary adjournments shall be granted to either side.
The writ petition is, accordingly, disposed of.
